CALIFORNIA ACT

Benchmark Electronics is pleased to share our guiding principles and efforts to ensure the integrity and dignity of the workers in our supply chain. Our suppliers are an integral part of our manufacturing activities, which facilitates our customers’ goal to provide their technology benefits to customers worldwide.

Benchmark requires our vendors and suppliers to maintain fundamental labor and human rights standards. Specifically, we include policies in our Standard Terms and Conditions of Procurement, Standard Supplier Agreement, Supplier Assurance Manual specifying that suppliers will follow all applicable laws (including labor, slavery and human trafficking laws) in the countries where they do business. Further, we require our suppliers to abide by the Electronics Industry Citizenship Coalition (EICC) Code of Conduct, which explicitly forbids forced, bonded (including debt bondage) or indentured labor, involuntary prison labor, slavery and trafficking of persons. We notify our customers of suppliers failing to meet these expectations and recommend their removal from the customers’ approved supplier list(s). We do not currently require our suppliers to certify that all materials incorporated into their products comply with the laws regarding slavery and human trafficking of the countries where they do business, however, we do require our suppliers to sign a statement committing to the EICC Code of Conduct.

Benchmark Electronics’ Supplier Assessments address social responsibility, and address a subset of the EICC Code of Conduct elements, including slave labor and sub-tier management. Supplier Assessment audits are based on risks identified by our global Supply Chain Management, scheduled in advance and conducted by trained Benchmark personnel.

Benchmark is committed to the EICC Code of Conduct. This includes Benchmark’s own commitment to legal and ethical behavior, including the avoidance of human trafficking and slave labor. Detailed internal financial auditing monitors proper payroll payments to employees.

Finally, the Benchmark Electronics Code of Conduct provides standards and procedures for employees, including respect and dignity for all workers. All employees receive recurring training on the Code of Conduct.
